If the Subscriber is going to or has in the past rented a product from the Company the Subscriber consents to the Company collecting and holding personal information for the purposes of providing relevant products or services (including assessing the application and identifying the Subscriber), managing and administering those products or services and protecting the Company, its insurer and its suppliers against fraud. The Subscriber consents to the Company also collecting personal information for the purpose of letting the Subscriber know about other products or services that might better serve their lifestyle needs or promotions or other opportunities in which the Company believes the Subscriber may be interested however if the Subscriber prefers not to receive this information the Subscriber has the right not to and should inform the Company by writing to the Company, P O Box 100, Macarthur Square NSW 2560. The information collected may include the Subscriber's name, postal and/or email address, date of birth, financial details, or other information the Company considers necessary to assess the Subscriber application or vary the Subscriber's Rental Agreement once established. Where necessary the Subscriber also consents to the Company collecting the Subscriber's personal information from third parties of the nature of credit reporting agencies, their representatives (such as a legal adviser), their financial advisers, their employers, Centrelink or from other publicly available sources of information.
The Subscriber consents to the Company disclosing personal information to the organisations described below. When the Company does disclose the Subscriber's personal information it will always seek to ensure that the information is held, used or disclosed consistently with the National Privacy Principles in Schedule 3 of the Privacy Act 1988. Except where the Subscriber tells the Company not to release personal information to organisations, they consent to the Company disclosing personal information to those that help the Company provide, manage, promote or administer the Company’s products and services such as third party suppliers, product partners, printers, postal services, financial institutions, payment organizations, insurers and advisers as well as the Subscriber financial and legal advisers and government or regulatory bodies whose purpose is the prevention or detection of unlawful activities or fraud. The Subscriber's also consents to the Company providing information to credit rating agencies for the purpose of obtaining a credit rating, score, report or assessing the risk of default under the Rental Agreement or the likelihood that the Goods may not, where relevant, be returned upon completion of the Rental Agreement. The Subscriber acknowledges that the Company reserves the right to decline an application for rental if the Subscriber does not consent to the collection and disclosure of the Subscriber's personal information for the purposes of the Company obtaining a credit rating on the Subscriber.
The Company always endeavours to ensure that the personal information it collects, uses or discloses is accurate, complete and up-to-date. If the Subscriber believes their personal information is not accurate, complete or up to date, it should inform the Company by contacting Company on privacy@1stchoicerentals.com.au.au
The Company stores information both in physical and electronic formats. The security of personal information is important to the Company and the Company always endeavours to ensure it is protected from misuse and loss and unauthorised access, modification or disclosure.
The Subscriber has the right to be given access to their personal information except where access would pose a serious threat to the life or health of any individual and/or access would have an unreasonable impact on the privacy of others and/or their request is frivolous or vexatious and/or the information relates to a decision making process that is commercially sensitive for the Company and/or providing the Subscriber with access would be unlawful and/or providing access would infer with the enforcement activities of government authorities in relation to criminal and/or activities and other breaches of law and/or providing access would infer with the Company’s negotiations with the Subscriber and/or the information that the Subscriber requests relates to a legal dispute between the parties to the Rental Agreement in which the information requested is privileged and/or denying the Subscriber access is required or authorised under law. If the Subscriber wishes to access their personal information they should contact the Company by writing to privacy@1stchoicerentals.com.au and the Company will, provided there is nothing of the nature described above that prevents the Company from doing so, arrange for the Subscriber to be given access to personal information that the Company holds.
The Company will not collect information about the Subscriber that reveals their sexual orientation, ethnic origins, political affiliations, religious or philosophical affiliations, memberships of associations or trade unions, details of disabilities or any criminal record except where the information is necessary to pursue or defend a claim in equity or in law or where the collection is, if such information is required by law.
If the Subscriber has any concerns about their privacy or personal information that they wish to discuss they are always welcome to contact the Company on privacy@1stchoicerentals.com.au and the Company will always endeavour to address their concerns. If further investigation is required the Company will keep the Subscriber advised of the progress of the investigation and if necessary their complaint or concern will be escalated for action to one of the Directors of the Company.
